Our scheduled <br />decision date is May 4, 1995; therefore, we request a response on or prior to that date. Please <br />let us know if additional time is needed in order to prepare an adequacy response. <br />1. The Division will require proof of publication and proof of notice to all owners of <br />record of surface rights and all owners of record of lands that are within 200 feet of the <br />boundary of the affected land. <br />2. There are several permanent man-made structures that appear to be within 200 feet of <br />the disturbed area. These structures are Colorado Highway 67 and a buried natural gas <br />pipeline owned by the Colorado Interstate Gas Company. The Division will require <br />that you either maintain a minimum 200 foot setback from these structures OR <br />provide a waiver from the owner of each structure that Fremont Paving &Redi-Mix, <br />Inc. will repair any damages to the structure resulting from mining or reclamation. <br />3. The mining plan specifies that access to the pit will be from Colorado Highway 67 <br />along an existing access road. And, that the road will not require upgrading nor will <br />it be included in the permit area. The Division requests that you clarify the ownership <br />and status of the road intended for access to the mining operation. Is the road public <br />or private? Has the operator received permission from the owner of the road? Has <br />the owner of the road waived the requirement for repairs due to the mining operation? <br />Has the owner of the road been notified of the proposed operation via the public <br />notice process? <br />4. The mining plan specifies that an asphalt batch plant may be used periodically <br />throughout the life of the operation. The Division requests that you provide a spill <br />containment plan for oil, grease, and any other petroleum products that may be <br />associated with the use of the asphalt batch plant. <br />COLORADO <br />
