Lamm <br />Governor <br />November 22, 1985 <br />Mr. Bob Siegrist <br />Colorado Sand and Gravel <br />6999 York Street <br />Denver, Colorado 80229 <br />Re: Colorado Sand and Gravel Quarry -Amendment, File No. M-80-110 <br />Dear Mr. Siegrist: <br />I have reviewed the 112 amendment application for the above captioned <br />operation and have several questions and comments organized on an <br />exhibit-by-exhibit basis below. Any exhibit or part thereof not mentioned is <br />considered adequate for Board approval now. Please respond to this letter at <br />your earliest convenience, but certainly by no later than December 13, 1985. <br />In this way, I will have adequate time to review your responses and clarify <br />any final question areas that may remain before the scheduled <br />December 18-19, 1985 Board meeting. <br />Please be advised that I have consulted with Peter O'Connor to familiarize <br />myself with the history of this site which lead to the submittal of this <br />amendment application. This should allow me to make my review more directly <br />applicable to the conditions on site. <br />I have the completed succession of operators form for permit number hi-80-110 <br />from Henderson Development Co. to Colorado Sand and Gravel. This form is in <br />order, and your request for the permit transfer will be scheduled to <br />immediately preceed the amendment application on the December meeting agenda. <br />Since a request for a succession of operators must be accompanied by a <br />complete warranty package, I will either request that the Board conditionally <br />approve the succession of operators request (based upon future submittal of <br />the approved financial warranty for the amendment); or we can agree upon that <br />financial warranty amount, you can submit the warranties, and the Board can <br />approve the request in concert with the approval of the amendment. In any <br />case, I have enclosed both a Performance Warranty and a Financial <br />Warranty-Corporate Surety form for your use in this regard. <br />Before our Board can consider this amendment application, our Division must <br />receive proof of the four sequential weeks of publication in a local newspaper <br />(publisher's affidavit or a copy thereof) and the proofs of notification to <br />all adjacent landowners (certified mail white or green receipts or copies <br />thereof). Please send us these items as soon as they are available. <br />Exhibits C and D <br />1. I note from examining the map exhibit C-2, that there are four <br />residences and U.S. Highway 85 within 200' of the affected land.
