<br />Mr. Curt Sealy <br /> <br />2- <br />AIIG 2 0 1998 <br />l) Recognizing that Umetco has already backfilled the outer portion of the Burro Tunnel, no <br />additional work shall be performed at the portal site, or within a 40-foot radius of the <br />portal; this area shall be preserved in its present condition. <br />2) The ventilation shaft, located approximately 880 feet east northeast from the Burro <br />Tunnel portal shall be preserved in its present condition. <br />3) Recognizing that the access roads to the Burro Tunnel portal and the ventilatio~t shaft are <br />within the areas to be reclaimed, Umetco shall ensure that these access routes are <br />retained, or reconstructed in a manner similar to their present, usable condition. <br />A stockpile oflow-grade ore (approximately 600 tons) currently exists at the Burro Tunnel site, <br />located on a portion of the Burro Tunnel mine-waste-rock dump. A previous operator of the <br />Burro Mitte Complex has informed GJO officials that this stockpile was mined in part from <br />Lease Tract C-SR-13. Accordingly, DOE has a financial interest in this stockpile. In a previous <br />discussion with Mr. Bates, he indicated that Umetco has no interest in the stockpiled material. <br />GEMI has indicated [hat it may be interested in retrieving and processing (blending with other <br />lease tract ores) this stockpile, depending on its value. Two representative samples of Ibis <br />stockpile were collected for analysis, and GEMI will use the results to make the determination <br />(expected early next week). Umetco will be notified of GEMI's decision prior to commencement <br />of reclamation activities at the site. <br />DOE has contacted Mr. Tom Gillis, Colorado Division of Minerals and Geology (DM()), and <br />informed him that these requirements are being imposed. Mr. Gillis indicated that Umetco <br />should have no problems associated with its DMG permit; however, he recommended xhat <br />Umetco contact his office to process the proper notification paperwork. <br />If yotl have any questions concerning this matter, please contact me at (970) 248-6004. <br />Sincerely, <br />cc: <br />D.
