Box 666 <br /> ' Florissant, CO. 80816 <br /> RE: Gravel Pit - Sec. 2, T13S, R71W <br /> ' Dear Frank; <br /> This letter is to confirm our telephone conversations in which <br /> ' we discussed your gravel pit, located in Florissant, Colorado. <br /> From the information that I have been able to gather, your <br /> gravel pit have been in operation since 1950, either under yours, <br /> 1 or other individuals ownership. <br /> Teller County Zoning Regulations state that a "Mining <br /> Operation" requires a Conditional Use Permit, within an <br /> Agricultural (A-1) Zone. For all new mining operations, I do <br /> ' require a Conditional Use Permit, prior to beginning operations, <br /> however, for an old mining activity, this is not required. <br /> Article IV, Nonconforming Uses, states that " . . .the lawful <br /> ' uses of land or structures existing at the time of adoption or <br /> amendment of this resolution may be continued even thought said use <br /> or structure does not conform to the provisions of this <br /> ' resolution. " <br /> Article IV: 3, further states "If a nonconforming use or <br /> structure be discontinued or unused for a period of twelve: months <br /> is shall be deemed ended and may not be resumed. " <br /> From the information I have gathered, it appears that your <br /> operation has been in continuous operation (operating at least once <br /> a year) , since 1950. Teller County adopted the Zoning Regulations <br /> ' in 1973, so your Mining operation is considered a Nonconforming <br /> Use, and is legal in Teller County, by my determination. <br /> Should you have any questions on this matter, or if you need <br /> ' further assistance, please feel free to call upon me. <br /> Sin <br /> ' Kevin I.
