We have received a <br />financial warranty in the amount of $145,500 for Phase I of the operation, but we have not received a completed <br />performance warranty from Coulson Excavating. I have attached a performance warranty form for your use. We <br />also have not received proof of completing re-notification and re-publication requirements as specified in the <br />Division's September 28, 2004 correspondence. <br />Please submit a completed perforrllance warranty form and proof of re-nofification and re-publication at your <br />eazliest possible convenience. All such items will need to be received in our office prior to the scheduled re- <br />consideration hearing before the Boazd. In addition to completing re-notification and re-publication procedures as <br />specified in Rule 1.6, please be aware that if any surface owners, easement owners, and owners of pertrlanent man- <br />made stmctures within 200 feet of the affected land are different than what was submitted in the approved <br />application, then new maps and exhibits will need to be submitted to the Division. Also, if any new permanent man- <br />made structures have been constructed within 200 feet of the affected land since the initial review period, then the <br />applicant will need to demonstrate compliance with Rule 6.4.19 regazding permanent man-made swctures.
