;~
BEFORE THE: MINED LAND RECLAMATION BOARD
STATE OF COLORADO
Permit App.: FILE NO. M-2004-067
IN RE:
The Permit Application of:
fiECEI~/ED
FEB 2 ~ 2Cff5
MMRR QUARRY;
Division ~f Minerals and Geology
Possibly a/k/a
CLEAR CREEK DISTRICT WATER PROVIDERS, LLC
MOTION OF
BLACKHAWK -CENTRAL CITY SANITATION DISTRICT
FOR
PARTY STATUS
COMES NOW the Black Hawk - Cenfra~~ry Sarutah'on Distriot ("B7iCCSIS"j and
seeks party status in the captioned matter pursuant to Rule 2.5.5, 2C.C.R.407-4. As grounds,
BHCCSD states:
i. BHCCSD is currently constructing a $22,000,000.00 wastewater treatment
facility adjacent to the proposed quarry project for the treatment of approximately 2 million
gallons of wastewater per day.
2. The plant location and construction along North Clear Creek is the result ofmany
yeazs of site research, planning and permitting to insure its structural and operational soundness
and to avoid any possible release of sewage or other contaminants into North Clear Creek which
flows into Golden and other downstream communities where its waters aze used for public
consumption.
3. The plant consists of numerous very lazge concrete tanks containing untreated and
partially treated sewage and sludge as well as tanks of potable and non-potable water. These
tanks have been engineered with special concern that they remain in place in the rocky canyon
environment in which they have been constructed. Their proximity to North Cleaz Creok
presents special environmental concerns.
a. Blasting, excavation and other construction neaz the site may endanger the
structural integrity of the concrete tanks and piping systems.
