McMindes: <br />• Colorado Yainpa Coal Company (CYCC) has requested an exemption from the <br />permit requirement to construct sediment ponds p, R and S on Area 6 at <br />Energy Mine No. 2. Rule 4.05.2(2) requires that sediment ponds be <br />maintained only until the disturbed area has been reclaimed, herbaceous <br />cover on the revegetated area is at least 90% of the cover of the <br />reference area and the quality of the untreated runoff meets applicable <br />State and Federal water quality standards. Nn adequacy letter was sent <br />on July 11, 1983 to which CYCC responded on August 23, 1983. CYCC <br />submitted additional veyetation information, sediment yield calculations <br />and actual runoff quality data. <br />The vegetative cover data shows that the herbaceous cover on Area 6 is <br />greater than the herbaceous cover on the pasture reference area. The <br />water quality data submitted by CYCC indicates that ponds are not needed <br />for Area 6 because the untreated runoff meets water quality standards. <br />Also, there is no point source discharge from Area 6 since the Department <br />of Health has released the site from IVPDES requirements. <br />Based on the vegetative and water quality data submitted oy CYCC, the <br />Division recommends that the technical revision request be approved. The <br />request is in compliance with Rule 4.05.2(2). If however, an inspection <br />reveals an area of erosion or gullying, the operator may be required to <br />implement alternative sediment control measures and/or re vegetation to <br />remedy the problem. <br />• <br />Ex. 29-27 <br />a23 Centennial Building, 7373 Sherman Street Denver, Colorado 80203 Tel.
