��` III IIIIIIIIIIIIIIII <br /> 19/ <br /> LAND RECLAMATION BOARD v 999 <br /> Department of Natural Resources <br /> Room 215, 1845 Sherman St. Telephone: 892-3401 <br /> Denver, Colorado 80203 <br /> Guideline for <br /> Land Stabilization and Reclamation Agreement <br /> THIS AGREEMENT is entered into this day of , <br /> 1974 by and between THE STATE OF COLORADO, by and through its Director of <br /> Natural Resources and the Land Reclamation Board (hereinafter referred to <br /> as "State") and Flatiron Paving Co. of Boulder (hereinafter referred to <br /> as Flatiron ) . <br /> W I T N E S S E T H <br /> WHEREAS, Flatiron desires to operate a sand and gravel <br /> pit <br /> in portions of Sections 20,29 ,30,T2N,R68W Weld County, <br /> Section, owns .p, Range, County ppit <br /> Colorado, better known as the Nelson Dtim9G and <br /> WHEREAS, Flatiron has submitted a plan on the Proposed <br /> Land Stabilization and Reclamation Procedures for the proposed sand and gravel <br /> x1m operations; and, <br /> WHEREAS, Said Sand and gravel A91 t <br /> emwill be operated for the <br /> purpose of extracting Sand and gravel for commercial marketing and, <br /> WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br /> statutory authority for the Land Reclamation Board of the State of Colorado <br /> to enter into agreements with operators or persons in charge of mining <br /> operations such as those contemplated by Flatiron to insure that the <br /> necessary stabilization and reclamation work will be done to prevent land- <br /> slides, floods or erosion. This section of the law further provides that <br /> the Land Reclamation Board requires a performance bond conditioned upon the <br /> faithful performance of the stabilization work required by the Board; and, <br /> WHEREAS, The Land Reclamation Board has determined that the <br /> mining operation to be conducted by Flatiron in said Sections <br /> 20,29 ,30 could have an adverse affect on the environment and could <br /> rosult in landslides or erosion if proper stabilization and reclamation <br /> procedures are not followed. <br />
