The Division of Minerals and Geology ("Division") is under
the same time constraints stated in the December 2, 2005 Second Adequacy Cotnment letter, therefore your response to
the following adequacy review concern should be submitted to the Division as soon as possible.
1. Division staff has attempted to review the Geotechnical Stability report submitted by the applicant, regarding
the slope on which the access road is to be constructed. The table of contents of the geotechnica] report shows
that there is a "Test Boring Location Sketch" included in the report. The materials submitted, however, do not
contain this sketch. In order for Division staff to conduct an independent slope stability analysis, the Test
Boring Location Sketch is necessary. Please supply this sketch.
2. Division staff has determined that a design for the road will need to be submitted to the Division prior to road
construction. In that the access road is a critical feature of the mining operation, and actual mining operations
cannot commence at the site prior to the installation of this roadway, the Division will need to review this
design prior to approval of the permit.
Please be aware that due to the slope conditions at the site, the Division will likely require periodic inspections during
construction of the roadway by a geotechnical engineer, and notification from the operator to the Division of the road
construction schedule so that the Division can do at ]east one inspection during road construction. There may also be a
requirement for the operator to commit to providing an as-built report for the road. These issues, if they become a
requirement of the permit, will be addressed in a stipulation to the approved permit.
Please be awaze that response to this issue falls under the same deadline as those contained in the second adequacy
review letter.
[f you have any questions, please do not hesitate to call me at (970) 259-5861.
Sincerely,
1
~•
Kate Pickford
Environmental Protection Specialist
cc: Harry Posey; DMG
Office of Office of Colorado
nn~,.o.t i ~..a rlo~lom~n..n Arrive and Inarrive Minec Geoloeical Survev
