McLain ) Minerals and Geology to Approve an <br />Application for a Limited Impact Operation <br />110(2) Reclamation Permit <br />AFFIDAVTI' OF GLYNDA YODER <br />I, Glynda Yoder, submit the following sworn statement in connection with the appeal of <br />Permit Number M-99-074 issued by the Colorado Division of Minerals and Geology: <br />1. I am the President of Precious Offerings Mineral Exchange, Inc., the Applicant <br />identified in Permit Number M-99-074. I am personally familiaz with all of the following facts. <br />2. Precious Offerings owns the Brown Derby #4 and Brown Derby #5 unpatented <br />lode mining claims. The Brown Derby #4 claim covers the Brown Derby Mine, which was <br />operated during World War II under authority of the War Production Board. <br />3. I am informed and therefore believe that owners of the Brown Derby Mine have <br />used Brown Derby Mine Access Road for access to the mine since this road was constructed by <br />the United States government with federal funds in 1944. <br />4. Mr. John Reardon, Precious Offerings' immediate predecessor in interest to the <br />Brown Derby claims, was using Brown Derby Mine Access Road in 1997. After Precious <br />Offerings acquired the claims from Mr. Reardon in June 1998, Mr. McLain requested that <br />Precious Offerings demonstrate its right to use Brown Derby Mine Access Road. In August <br />1998, Precious Offerings presented Mr. McLain with information demonstrating that Brown <br />Derby Mine Access Road was constructed with public funds by the United States Forest Service <br />following certification of construction by the War Production Boazd, in accordance with the <br />Defense Highway Ac[ of 1941. Mr. McLain acquiesced and did not prohibit Precious Offerings <br />from using the road after the August 1998 presentation. <br />5. Precious Offerings sent its Reclamation Penrnit Application for processing by the <br />Division of Minerals and Geology on September 17, 1999. <br />
