Mined Land Reclamation Page 2
March 3, 1983
The Mesa County Resolution that was inserted in the mining application stipu-
lates that pit water should be pumped into the DeBeque pond if its water table
is being lowered by the mining operation. During periods of call on the river
basin, Corn cannot legally divert water to this pond unless the pond has a
senior adjudicated water right that allows this diversion. Our office will
order Corn to cease any illegal diversion such as this.
The Larkin Ditch Flows immediately adjacent to the east side of the permit
area. The application states that the ditch is at present perched above the
gravel deposit and above the water table in the gravel deposit. Because of
this, Corn does not anticipate that dewatering will have any efFect upon the
ditch. While this statement may be correct, we believe that Corn should meet
with the owners of the Larkin Ditch to mitigate their concerns. Parshall
flumes could be installed before the ditch nears the permit area and after it
leaves the area to measure any change in flow that might occur due to
increased seepage.
In conclusion, we do not recommend approval of this application until Corn
addresses the issues raised in this letter. Further, we will order the appli-
cant to cease operations if excavation begins without the required well per-
mit. We have enclosed an example well permit to be forwarded to Corn
Construction.
HDS/JRH:ma
Enclosure
cc: Lee Enewold, Div. Eng.
