SUfTE 227 • DELTA • COLORADO.814161764 <br />www.deltacounly.com planninaCo~deltacounri.com <br />PHONE: (970) 8742110 fax (970$74-2500 <br />THIS AGREEMF~IT is issued pursuant to t)elfa County Regulation for Specific <br />Development, effective January 10, 2005, adopted by Resolution 2005-R-003 on January 24, <br />2005. <br />Applicant: Eldon Reynolds <br />691 vents Drive <br />Delta, CO 81416 <br />Development: Reynolds Gravel Pit <br />Application No.: SD 01-016 <br />Matters and Evidence Considered by the Board: <br />This application for a Speafic Development Regulation to operate a gravel pit on property <br />owned by Gregory Fedler and Eldon Reynolds located within Section 15, Township 15 South, <br />Range 96 West of the 6°i P.M., in Delta County, Colorado, was presented to the Board of County <br />Commssioners on December 5, 2005, at which time the Planning Staff informed the Board that <br />Mr. Fedler and Mr. Reynolds have requested that this development be split between them and <br />separate Deveopment Agreements be written. The Board directed Planning Staff to proceed with <br />writing separate Development Agreements and approve the separation of this development <br />administratively. <br />Legal Matters: <br />The Board reviewed the separation of this devebprrrent at its regular meeting on <br />December 5, 2005, after due notice, at which time the Applicants testified concerning their <br />position. The Board took the application and testimony under advisement <br />Findin <br />The Board adopts the findings of the Planning Staff, es set forth on Exhibit A, attached <br />hereto and by this reference made a part hereof. <br />The Board further finds that the proposed development is not irrcompatibie with the <br />neighbofiood, assuming that the recommendations of the Planning Staff and Planning <br />Commission, adopted as conditions for approval of the appligtwn, are complied with by the <br />Applicant. <br />The Board further finds that although the proposed deveopment results in significant <br />potential impact to the neighborhood, inducting such negative impacts as noise, dust, increased <br />traffic, etc., those impacts can be substantially mitigated by compliance with the conditions set <br />forth below. <br />Decision: <br />For the foregoing reasons, the application SD 01-016 shall be and hereby is approved, so <br />long as the Applicant agrees to comply and acttrally complies with the conditions below. <br />
