Attached is a copy of the response from CDPHE received by the <br />Division on August 1, 2005. We advise you to contact the following CDPHE staff if you need further <br />details on radiation issues pertaining to your quarry pemilt application and matters within CDPHE <br />authority. <br />• Edgar Ethington, Radiation Management Unit @ (303) 692-3438 <br />• Roland Hea, Air Pollution Control Division @ (303) 692-3252 <br />• Gary Beers, Water Quality Control Division @ (303) 692-3524 <br />Listed below aze revised comments 22-30 of the Division's previous adequacy review letter of June 30, <br />2005 and July 22, 2005 "Reconsideration of Questions 22-30 in 2""Adequacy Review Comments". These <br />comments pertain to radiation concems in relation to protection of surface and groundwater resources that <br />have been raised by objectors. Specifically, objectors have raised concerns over the protection of water <br />quality in nearby North Clear Creek and up-gradient groundwater sources. It is our understanding that <br />there will be offsite discharge of storm water from your proposed operation into North Clear Creek. Please <br />address all adequacy concems of the Division and the concems raised by the objectors, <br />When responding to these concems please keep in mind [hat Rule 3.1.6 (1){b) of the Rules & Regulations <br />for the Extraction of Construction Materials requires that: <br />"Disturbances to the prevailing hydrologic balance of the ai9'ected land and of the surrounding area and <br />to the quantity and quality of water surface and groundwater systems both during and after the mining <br />operation and during reclamation shall be minimized by measures, including, but not ]invited to <br />compliance with applicable federal and Colorado water quality laws and regulations, including statewide <br />water quality standards and site-specific classifications and standards adopted by the Water Quality <br />Control Commission; " <br />See also § 34-32.5-116(4)(h), C.R.S. <br />Office of Office of Colorado <br />Mined Land Reclamation ARive and Inactive Mines Geological Survey <br />
