The operator will not slab mine within 200 fee[ of any significant, valuable, or <br />permanent man-made structure until the operator submits to the Division one of the <br />following items: <br />1. Provide a notarized agreement between the applicant and the person(s) having <br />an interest in the structure, tha[ the applicant is to provide compensation for <br />any damage to the structure. <br />2. Where such agreement canno[ be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall <br />not be damaged by activities occurring at the mining operation. <br />This stipulation shall not prevent the operator from conducting surface rock removal <br />activities as defined in the approved permit application within the structural buffer <br />zone of 200 feet. <br />3. No blasting will be conducted on site until the applicant submits and receives approval <br />for a blasting plan that cleazly demonstrates through appropriate blasting, vibration, <br />geotechnical, and structural engineering analyses, that off-site azeas will not be <br />adversely affected by the proposed blasting. <br />The amount of financial warranty set by the Division for this operation is $26,100.00. The Mined Land <br />Reclamation Boazd will review Staff s recommendation for approval during the February 25-26, 1998 Boazd <br />Meeting and make a final decision for approval or denial at that time. <br />PLEASE NOTE THAT MINING OPERATIONS MAY NOT COMMENCE UNTIL A PERMIT HAS <br />BEEN ISSUED BY THE DIVISION AND AFTER RECEIPT OF YOUR FINANCIAL WARRANTY <br />AND PERFORMANCE WARRANTY. <br />If you have any questions, please contact me. <br />Sincerely, <br />,.~-~a w~ <br />Anthony J.
