Section 780.21 (b) Continued. <br />outside the permit area, but also to provide a means of compliance <br />with all applicable effluent limitations, especially with respect <br />to TSS. The effluent quality is regulated by 30 CFR 816.42 and by <br />Energy Fuels' NPDES Permit, No. CO-0027154. This permit, issued by <br />the State of Colorado Department of Health under the National <br />Pollutant Discharge Elimination System, established as a result of <br />the Clean Water Act (33 U.S.C. Sec. 1251 et seq.) sets the most <br />stringent effluent limitations of all applicable rules and regu- <br />lations. the permit is presented in full in Exhibit 17, NPDES <br />Permit, and specifies a daily maximum concentration of TSS of 30.0 <br />mg/1, a maximum of 2.0 mg/1 for total iron, and a pH range of 6.0 <br />to 9.0. Additionally, the Permit provides that there shall be no <br />discharge of floating solids or visible foam in other than trace <br />amounts and that the concentration of oil and grease shall not be <br />greater than 10 mg/1 or produce a visible sheen on the water surface. <br />No thirty-day average concentration limitations are provided for <br />• any parameter. <br />In order that all operations, both in the existing Energy Mines No. <br />1 and 2, and in the new Eckman Park area, have proper drainage and <br />sediment control, new ponds will have to be constructed in Eckman <br />Park and Ponds B, H, K, N, 0, P, and Q at Energy Mines No. 1 and 2 <br />will have to be modified to reflect new design criteria or changes <br />of mining and reclamation activities within the corresponding <br />watersheds. <br />Additional discussion and the presentation of site specific plans <br />and design criteria, both hydrological and geotechnical, are set <br />forth under Sections 780.25, 816.46, 816.49, in Exhibit 13, <br />Sedimentation Ponds - Hydrologic Investigations, and in Exhibit <br />14, Sedimentation Ponds - Geotechnical Investigations. <br />• <br />780-158 <br />
