Cattany <br />Division DIreCTOr <br />Natural Resource Trustee <br />The Colorado Division of Reclamation, Mining & Safety (DBMS) has reviewed the <br />Responses to Preliminary Adequacy Review-O1 for Sundance Resources Regulaz 112 <br />Permit Application, dated February 20, 2007, for Lafazge West, Incorpora[ed's (Lafazge) <br />Sundance Sand and Gravel Resource property in EI Paso County. Following a request <br />for extension submitted to DBMS on 2 Januazy 2007, the revised decision date for this <br />application is 2 Mazch 2007. With the exceptions described below, DBMS accepts the <br />applicant's responses to our Preliminary Adequacy Review-O1. DBMS is unable to <br />approve the application until these exceptions have been satisfactorily addressed. <br />On the basis of phone conversations with you and Mazk Vigil of LaFarge the week of 26 <br />February 2007, it is unlikely that LaFazge will be able to meet these conditions by the <br />new 2 Mazch 2007 decision date, therefore DBMS recommends that LaFarge file a <br />request for extension of the decision date. <br />Rule 6.4.3 Exhibit C -Pre-Mining and Mining Plan Map(sl of Affected Lands <br />Exhibit C-I :Pre-Mine Plan Map shows an on/gas well within the proposed permit <br />boundary. A permit number is shown and the well is stated to be abandoned. However, <br />under the General Notes, a less convincing statement is made that the well is "believed to <br />be abandoned or subject to leases under control of the land owner." Please provide <br />assurance that LaFarge has reseazched this well and is certain that it is indeed abandoned <br />or subject to leases under control of the land owner.
