Claritication for the Public Notice sent via Certified mail to lhvners of Affected Land (immediate <br />adjacent landowners to permit areal <br />• An error m the initial adjacent landowner notifications sent via certified mail read as follows: <br />"Comments concerning the application and exhibits must be in writing and must be received by the <br />Division of Minerals and Geology~by 9:00 p. m. on the decision date. " <br />• The correct text is the text which was published in the Public Notice section of the Montrose Daily <br />News on Mazch 24'h, Mazch 31°`, April 7th, and April 14th (April 14ei being the last day of <br />.r publication + twenty (20) days will make May 4`" 2005, the last day for public comment) stating <br />1' <br />the following: <br />•"Comments concerning the application and exhibits must be in writing and must be received by the <br />Division of Minerals and Geology by 4:00 p, m. on May 4, 2005. " <br />As pec Section 1;7.1(2)(a) of the Minerals Rules and Reaulations.ofdhe•Colorado MinedLand'. <br />Reclamation Board for the Extraction of Construction Materials conceroing the Submission of _ __, <br />Comments and Petitions for a Hearing: <br />"bt the case of a 112 Reclamation Permit Application, such written comments, protests, and petitions for a <br />hearing must be received by the Office not more than twenty (20}caleridaz after the last date.for.the- ' ~ ~- <br />newspaper publication of notice of application provided for in Subparagraphs 1.62(1)(d) and:1.6.3(3). The <br />Office may set the matter for a hearing before the Board upon timely receipt of a written petition for a <br />hearing under this Subparagraph, but m any case shall approve or deny [he application within thirty (30) <br />days ofthe date the office considers the application filed accordmg to [he provisions ofParagraphs 1.4.1(9), <br />(13) or L8....." (Thursday, April 14th being the last day of publication + twenty (20) days makes <br />Wednesday, May 4, 2005 at 4:00 PM the last day for public comment) <br />
