<br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />PRE-HEARING ORDER <br />IN THE MATTER OF COLORADO GRAVEL PRODUCTS, INC., THE COLORADO <br />GRAVEL PRODUCTS PTT, FILE NO. M-99-117, APPROVAL OF A 112 PERMIT <br />APPLICATION OVER OBJECTION <br />This Pre-heazing Order is proposed to the Mined Land Reclamation Board ("the Board") by the <br />Pre-hearing Conference Officer, Sandra Brown, to govern the hearing in this matter. This Order, <br />and amendments thereto, if any, shall be effective upon approval by the Board. If any party has <br />objections to the provisions of this Pre-hearing Order, those objections must be raised at the final <br />hearing before the Board during its deliberations under Section V. below. <br />I. FORMAL PUBLIC HEARING <br />The Formal Public Hearing on this matter (unless noticed otherwise) shall be held before [he <br />Board on May 24, 2000, at the Centennial Building, 1313 Sherman Street, Denver, Colorado, <br />80203, Room 318, during [he Board's regular May meeting. The Board's agenda (unless noticed <br />otherwise) will begin at 9:00 a.m. <br />II. PARTIES <br />The Pre-hearing Conference in this matter was held by conference call on May 8, 2000. Kenny <br />Smith appeared on behalf of the applicant. The sole Objector, Mrs. Frances McCormick, did not <br />appear, nor did any person appear on her behalf. Mrs. McCormick was contacted by phone three <br />times, and she chose not to participate in the Pre-hearing Conference. She did not advise the Pre- <br />heazing Conference Officer or the Division staff that on May 1, 2000 she had authorized her <br />daughter, Rita Post, to represent her. The authorization was received by the staff representative <br />after the Pre-heazing Conference, and no phone number or address for Rita Post was included. <br />Note: The Division of Minerals and Geology ("Division") shall not be a party, but shall <br />participate in the hearing as staff to the Board. <br />III. ISSUES TO BE CONSIDERED <br />Presentations to the Board shall be strictly limited to the issue of whether the pending application <br />complies with the requirements of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Sections 34-32.5-101 et sec .., C.R.S. (1999) ("Construction Materials <br />Act") and the rules and regulations promulgated by the Board. No person presented any issues <br />for the Board's consideration during the Pre-heazing Conference. <br />
