Long <br />Saguaehe, Colorado 81149 Division Director <br />Re: Coleman Pit, File No. M-95-075 <br />Dear Mr. Baker. <br />During our phone conversation of April 4, 1996, you stated you are not objecting to Saguache <br />County's permit application, so you will not attend the informal conference. Since you are not <br />objecting, the informal conference has been canceled. <br />You said your main concern was the exposure of groundwater. You feel that if you have to <br />replace evaporative losses (if groundwater is exposed on your property), then the County should <br />have to do the same if they expose groundwater on their property. <br />As we discussed, groundwater exposure comes under the jurisdiction of the Office of the State <br />Engineer. However, since the County committed to a dry pit, if they expose groundwater they <br />must backfill the pit until groundwater is no longer exposed or they must amend their permit to <br />include a pond and comply with State water laws. <br />As I previously stated, if you decide to open up a gravel pit on your property, give me a call.
