In the course of my review I also spoke <br />with Mike Long, our specialist who visited the site, and I examined the slides <br />taken at the site. Y'his conversation and examination leads me to the conclu- <br />sion that this operation affects considerably more land than 5 acres. Mike <br />Longs estimate is or, the order of 15 acres, and my analysis leads me to <br />agree with this figure. Therefore, this application is incomplete at this time. <br />There are several factors that come into play in this matter. First, Mike <br />Long informs me that there is considerable disturbance on the other side of <br />the Wommer Irrigatior, Ditch from the permit area indicated on your map. <br />Second, you should rE•fer to the enclosed copy of page 1 of the Mined Land <br />Reclamation Act, giving the definition of "affected land". All activities <br />under this definitior,~ are to be part of the permit area. Third;' all land <br />affected by Southwest Properties, Znc, since July 1, 1973 should be part of <br />the permit area. This is true even if the land was originally disturbed by <br />another operator and was then redisturbed by Southwest Properties. <br />My suggestion is that: you resubmit your application with all the disturbed <br />acreage included in t:he permit area. This will entail submitting a 112, re- <br />gular impact permit application (four copies required) as soon as possible. <br />Please consult Rule 2 for instructions as to the method for putting such a <br />permit together. I Have enclosed a 112 form for your use. Although a receipt <br />for the $75.00 fee is enclosed, the balance of the appropriate 112 fee will be <br />due when you submit your lI2 application. <br />If I can clarify any parts of this letter, please call me. <br />Sincerely, <br />Mark S.
