that a u-shaped excavation will occur and daylight out the southwest point at or near the
location of the irrigation ditch. In addition, the post-mining contours on the south side of
the county road also need to be more detailed.
6.4.7 EXHIBIT G-Water Information
The application indicates that this operation is not expected to directly affect surface and
groundwater systems in the area. Please identify how these impacts will be minimized
especially in light of the fact that a batch or asphalt plant maybe utilized on the site at a
future date.
Under (2)(a), please identify and locate on the appropriate map the imgation ditch that
runs along the northeast side of Moss Creek. In addition, please clazify why the applicant
believes that the operation will not impact this feature.
The narrative in Exhibit D states that water for processing will become available at a
future date, however, under (3) of this exhibit the narrative states that there will be no
water requirements for this project, Obviously these statements contradict each other and
need lobe revised tg teflect that wester ~s Qr is nQL rewired for thi~~~o~ect, Ftu~~rmQrQ,
if water is required, Rule 6.4.7(3) & (4) require the applicant to provide an estimate of
project water requirements and indicate the projected amount from each source of water
to supply the project water requirements. Please clarify the narrative to comply with this
exhibit.
Finally, during the pre-hearing conference it was indicated that there is a 100 foot set-
back from Froze Creek, however, this is not cleaziy stated or shown in the application.
Based on the location of the northeast permit azea mazker, the affected azea could be

that Froze Creek is likely an ephemeral stream and aset-back would be appropriate in
this instance. Please clarify the narrative to indicate what the set-backs will be, if any,
