<br />1. Western Slope Carbon must monitor. ground water inflow into the extension
<br />of the 1st East Mains artd submit to•[l,e regulat~~r; ,-,i,:i,ur!ty monthly reports
<br />on :he quantity and q,~a;ity of water entering [he mine. The report should
<br />also include informat.ioct on [he urientar.ic„i acrd dzgree of fracturing in [he
<br />"E' seam and the roof and floor rock. the frequency of reporting may be
<br />adjusted only if appr,~vr,i 1iy [l,e r~•;;::1,r.~ry authority. If ground water inflow
<br />exceeds five gpm the regulatory authorities muir. ~~ notified immediately.
<br />:. (a) The East `tine sediment pond must be designed to totally contain the
<br />runoff from a 10-year, 24-hour storm (0.55 acre-ieet); unless WSC can
<br />demunscrate to the Regulatory Authority that a modification of the proposed
<br />system will comply with [Ile. requiremecits of 7i5.17(e). The required storage
<br />volume (0.55 acre-fee[) does no[ include sedimcr,t s_orage because runoff and
<br />sediment will be immediately pumped from the pond as proposed by WSC. A
<br />sediment pond design, acceptable to the Regulatory Authority, and certified by
<br />, ~;~..,litEird registered professional engtr,eer musc.be submitted within two
<br />.,eels of the approval.

<br />months of this approval. Any d.vi.,[;,,~, f,.,, ~.!~.;; schedule must be approved by
<br />the regulatory authority.
