<br />,,pprovcd for [he term of the permit, and ~~nly in the manner or with [lie
<br />processes and techniques described in the apuroved mining and reclamation
<br />pl.in.
<br />4. The operator shall (a) install, maintain, and use any monitoring
<br />equipment required by the Regulatory F,u[hnrity as a condition of this approval
<br />or required subsequent to approval'durlnr the, life of the mine; (b) e:;tablish
<br />,ins! maintain appropriate teco:ds of such monitoring; (c) evaluate the results
<br />in accordance with such methods, at such location, intervals, and in such
<br />,.,.,nner as the Regulatory Authority shall prescribe; (d) make reports of the
<br />rc:;ults of monitoring as required by the Regulatory Authority and (e) provide
<br />;u~:h other information as the Regulatory Authority shall require.
<br />5. The operator shall comply with the Surface Mining Control and
<br />~cclama[lon Act of 1977; the Federal Metal and Yunmerallic Nine Sate[y Act;
<br />the Federal Coal Mire health .and SaEery Ar.t cf 1969; the Federal Water
<br />7c.'.lution Control Act, as amended; the C1Pan Air .4c t, as amended; the F.esource
<br />Ce~•servation and Recycling Ac[, us amended; the Refuse Act or L899; the Fish
<br />~r.~'. 4111d1ife Coordination Act of 1934; the Miner.il Leasi~tg Act of 1920, as
<br />i_~•nded; and any regulation, perfur^•,ance Standard, effluent Limit, emission
<br />!Celt, water quality standard, or ambient air q~iality standard promulsated or
<br />=l roved there under, as we 11 ns all appl~.cahle state and local laws,
<br />•r:'lnances, regulations, standards, ar..l l+'.mttaciuns.
<br />• 6. Compliance •+ith any design criter+.a, or tnchnoingy requirement, e:en
<br />`-•re desigr. criteria nr the _nc`.,r.olu~y .:a; bran unproved by the Regulatory
<br />-hority, shall not relieve thz nper:tor or the duty to comply with any
<br />;licable effluent limitations, emission limitation, applicable performance
<br />'~ndard, water quality standard, ambient air ;;utility standard, or an}' order
<br />' ued by the Regulatory Authorit? under section 521 of the Surface Mining
<br />-crol and Reclaration Act.
<br />7. Tlie operator shall file a request with tl:e Regulatory Authority
<br /><ing the release of all or part of a perfnrma;~ce bond only during those
<br />sonal periods when i[ is possible for r.he Regulatory Authority to insp,=ct
<br />area subject to the proposed release and m;eke determination (a) regarding
<br />completeness of reclamation; (b) t;~e r~egree of difficulty to complete any
<br />+1n1ng reclamation, includin;; success of revev,eta[Son; (c) whether
<br />i[Lon of surface or subsurface water is occurring; and (d) the probability
<br />~stlma[ed cost of abating such pollution or other applicable recl:mation
<br />Irements.
<br />Each of the mining, rec;amatie.i ur monitoring procedures, techniques,
<br />~ds or descriptions contained in the approved mining ar,d reclamation plan
<br />any requirement, stipulation or condition established by the Rugulatory
<br />•i [y as par[ of any approval of a mininr, plan, or revision or
<br />cation tliareof, nr by order of t!ie Regional ~trec[or following such
<br />~1 shall be deemed a "permit. condition required by this Act" for the
<br />~s of enforcement under S,•c[iun iZl of r;i.~ Ac[ and "a condL[ion of ,t
