The Pemlittee, Pioneer Sand Company, Inc. desires to conduct a mining operation (mown as <br />Pioneer Farru, for the purpose of extracting Sand. The Permitlee will not mine any secondary commodities. <br />B. On October 31, 2000 the Mined Land Reclamation Board (the "Board"} approved the <br />Pemvttee's application for this pernit, fixed the amourrt of the financial warranty and directed that this pemut be <br />issued upon the filing with the Division of Minerals and Geology (the "Division") of performance warranty and <br />financial waraMy (or warranties) in the amount so fined m form and substance approved by the Division. Said <br />waranties have bece filed with the Division. <br />C. If the Pertnrttee desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On October 31, 2000 the Board made the following findings: <br />1. The apphcatioo for this pemmit oorrrpGes with the requirements of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construdien Materials, C.R.S. 34-32.5-101 et sue., as amended, and <br />with all applicable local state and federal laws; <br />2. The operation will not adversely affect the stability of any signifiL~nt, valuable, and <br />permanent man-made strudwe located within two hundred fed of the Aflixted Land• except where there is an <br />agreemart betwear the Operator and the persons havurg an interest in the structure that damage to the structure is <br />to be conyrarsated fior by the Pertnittee; and; <br />
