Messner <br /> J-Bar-B, Inc. <br /> 1805 Kipling Street <br /> Lakewood, Colorado 80215 <br /> Re: Bailey Pit - File No. M-84-099 <br /> Dear Mr. Messner: <br /> The Division has reviewed the Bailey Pit application to determine if it <br /> adequately addresses the requirements of Rules 2 and 6 of the Regulations.- <br /> The following questions and comments regarding the adequacy of the application <br /> must be addressed as soon as possible before the Board meeting. <br /> I. Exhibit A - Legal Description <br /> 1 . The legal description presented as Exhibit A does not correspond with <br /> the areas included on the maps, specifically the NE 1/4 SE 1/4 of Section 36. <br /> Please revise either the legal description or the maps. <br /> II. Exhibit C - Affected Lands Map <br /> 1. The affected land boundary does not coincide with the area being <br /> permitted. Please rectify this discrepancy. <br /> III. Exhibit D - Mine Plan <br /> 1 . Please describe the depth of topsoil to be salvaged and where the <br /> stockpiles will be located. The operator must ensure that sufficient topsoil <br /> is stockpiled during each phase of the operation to complete the reclamation <br /> needed at that stage. The 100 feet buffer zone area is an area of potential <br /> flooding and is therefore an inappropriate place to stockpile topsoil for <br /> erosion minimization. <br /> 2. Where will the processing facilities, offices, stockpiles, access roads <br /> and other mining related facilities be located?
