• • \ III III III III IIII III •'` <br />999 <br />October 10, 1980 <br />Mr. Barto Babltz <br />Fremont County Planning Director <br />Fremont County Court House <br />Canon Clty, Colorado 81212 <br />RE: Fremont County Gravel Operations to General <br />Dist. 11 Plt Amendment Our Flle: 118-95 <br />Dist. t2 Plt Our Flle: 179-216 <br />Dear Mr. Babltz: <br />Aa per our phone wnversatlon of th{s morning, 1 am writing to <br />Inform you of the situation concerning the mining and reclamation <br />permit applications for Fremont County: I hope this will clarify <br />the status of the various County gravel operations. <br />Until the Board lifts the tease and Dealst Orders Issued to <br />Fremont County on September 25, 1980, no permltt for new mining <br />operations may be granted. (Sae Section 34-32-120 of the Act, <br />enclosed.) Thls would Include the amendment to the Dlstrlct <br />11 PIt. <br />The orders can be lifted at the time permits are approved. This <br />would be true for the Dlstrlct 12 Plt. Concerning the operstlon <br />In the medium security prison area, our Dlvlslon Is In the process <br />of clarifying the responslblllty for mining and reclamation on <br />the sits. Ys w{11 consult with the Department of Corrections to <br />resolve this matter as soon as poaslble. <br />tf the permit for the Dlstrlct /2 Plt Is ready for Board approval <br />during the November 19-20, 1980 Board meeting end the rasponslbll- <br />Ity for the medium security prlaon site is satlsfactorlly clarified, <br />the Board should be able to lift thn two Cease and Desist Ordara <br />given to Fremonc Lounty, and permitting of County pits should be <br />able to proceed. <br />I am enclosing a complete letter for the Dlstrlct /1 Plt Amendment. <br />It Is my understanding that there may be some problem with the <br />Fremont County approval for zoning of this pit, however. Please <br />clarify this matter. I will also expect the wildlife statement <br />that Mr. Rupp mentioned Is In progress at th• Dlvlslon of Mlldllfe <br />offices In Colorado Springs. <br />
