I <br />have received a copy of your letter addressed to the Mined <br />Land Reclamation Division dated February 16. <br />You have made several conclusions in your letter that <br />are not supported by the facts, and that I think are fueled <br />in part by a misinterpretation of the function and scope of <br />the permit and the Colorado Mined Land Reclamation Act. I <br />cannot tell from your letter whether or not you have reviewed <br />the permit application. Virtually all of your clients' <br />concerns are adequately addressed by the application. The <br />proposed mine is a comparatively low volume operation. The <br />proposed area of mining activity would at its closest point <br />be more than half a mile from the property of your clients. <br />Your clients' property is vacant grazing land and your <br />clients live in another county. Therefore, there would be no <br />impact to your clients' residence. <br />with respect to your conclusions concerning dust, 1 <br />enclose a copy of the letter from the Colorado Department of <br />Health. As you can see, this low level, low impact operation <br />is anticipated to have very little, if any, effect on air <br />quality. Furthermore, the reclamation plan provides that if <br />any topsoil stockpiled for future reclamation purposes will <br />remain unused for one year, the topsoil stockpile will be <br />seeded. The stockpiles will be of low configuration to <br />prevent erosion, and topsoil will not be rehandled until <br />utilized in reclamation. The clay seam itself i~ not the <br />"dirt" that you refer to and it is not anticipated to <br />generate any dust problem.
