I left
a message on your answering machine on Friday, September 8, 1995,
briefly outlining the topics needing to be addressed. This letter
will explain what is needed for each of those items in depth. If
I have not listed an item under a particular exhibit, there is no
concern at this time. Please be reminded, this permit application
submittal does not constitute the application's approval or permit
issuance. These items must be addressed in a timely manner, in
part, because you are under a Board Order to obtain the permit.
Please refer to Minerals Rule 6.3 for the best explanations of what
is needed to complete these exhibits.
Exhibit B - Site Description
Part a. The vegetation and soils information is too general.
Please request from the local Natural Resources Conservation
Service office information sufficient to complete this exhibit.
(The NRCS was formerly known as the SCS.) Also please better
describe the extent of pre-existing disturbance.
Part b. You must include information related to all structures
inside the permit area and within 200 feet of the permit boundary.
Be sure include above- or below-ground utilities, fences, the
cemetery on the west (if necessary), Highway 160 on the north, Bean
Lane (Road 17) on the east, and the railroad on the south. You
must include structures that are within 200 feet, even if they are
on the other side of the roads. Where applicable, include the name
of the owner of the structure, plus whether a setback or easement
exists that is to be avoided, and evidence of an agreement for
damage liability or a justifiable statement of "no impact."
Exhibit C - Mining Plan
Please provide more detail about the depth of mining (will it be 25
feet deep?), direction of mining (will the separate pits eventually
join?), how and where topsoil will be segregated and stockpiled,
