O. Box 10775
Edgemont Branch
Golden, Colorado 80401
Dear Mr. Case:
Re: Open Mining Permit
This is to acknowledge receipt of your letter concerning your
application for an Open Mining Permit with the Land Reclamation Board.
After our phone conversation on February 18, 197G, I reviewed the
Rules and Regulations again and discussed them with Dr. Jeris Daniel-
son, Deputy State Engineer. While the wording of Section III, Para-
graph (F)(12)(a)(4), is somewhat misleading, the intent is with respect
to our regulatory functions where we issue permits for wells and certi-
ficates for dams which meet our statutory requirements. With respect
to your operation, if you have a permit for your on-site water require-
ments then you would enclose it with your application to the Land
Reclamation Board. If you have no need far water, then a brief dis-
cussion on this subject should be submitted to this office in writing
along with your request for a statement from this office stating tha: no
permit or certificate is required (Paragraph 12(a)(5)).
The land Reclamation Board has the option of requesting rericw
by our agency of the submitted materials in accordance with Section II,
Paragraph (c) (7) .
If you have further questions, please feel free to contact me,
111);:rnvq
t;c;; 1.tuu1 ltnc:l~unrttlon Hunrtl
Very truly y urs,
'I~'4~
ilnl 1).
