these areas will be returned to the approximate original contour promptly after such <br />features aze no longer needed for coal exploration". <br />"Prior to earth moving or excavations of any type, the A and B horizons will be <br />salvaged and stored in an azea that will be undisturbed and not subject to excessive <br />wind or water erosion. The underlying subsoil materials will, if necessary, be salvaged <br />and stored in an area separate from A and B horizon materials. Immediately upon <br />cessation of operations, the subsoil will be replaced with the surface lefr in a roughened <br />condition. The A and B horizons will then be replaced over the subsoil material". <br />"With the exception of small and temporary diversions of overland flow of water <br />around new roads, drill pads, and support facilities (such as staging areas or lay-down <br />areas), no ephemeral, intermittent or perennial stream will be diverted during coal <br />exploration activities. Overland flow of water will be diverted in a manner that (a) <br />controls erosion; (b) to the extent possible using the best technology currently available, <br />prevents additional contributions of suspended solids to stream flow or runoff outside <br />the exploration azea; and (c) complies with Colorado Coal Mining Regulation 4.05.3 <br />and all applicable State or Federal requirements." <br />"Coal exploration will be conducted in a manner which minimizes disturbance of the <br />prevailing hydrologic balance and which includes the use of sediment control measures <br />such as those listed in Colorado Coal Mining Regulation 4.05.5 or sedimentation ponds <br />which comply with Colorado Coal Mining Regulations 4.5.05 and 4.05.9." <br />" "Acid-forming materials", as defined in Colorado Coal Mining Regulation 1.04(2), <br />and "toxic-forming materials", as defined in Colorado Coal Mining Regulation <br />1.04(139), will be handled and disposed of in accordance with Colorado Coal Mining <br />Regulations 4.05.8 and 4.14.3." <br />As the Division has determined that the proposed coal exploration activities will <br />"substantially disturb" the natural land surface, and in accordance with the requirements <br />of Colorado Coal Mining Regulations 4.21.4(6) and (7), please add the following <br />paragraphs to Section 6.3.2 "Surface Reclamation" of the Notice of Intent: <br />"All facilities and equipment will be removed from the exploration azea promptly when <br />they are no longer needed for exploration, except for those facilities and equipment that <br />the Division determines to remain to provide additional environmental quality data, <br />reduce or control the on- or off-site effects of exploration activities, or facilitate future <br />surface coal mining operations by the person conducting the exploration under an <br />approved permit." <br />"Revegetation of areas disturbed by coal exploration will be performed by Western <br />Fuels-Colorado or its agent. Revegetation will be carried out in a manner that <br />encourages prompt vegetation cover and recovery of productivity levels compatible <br />with the approved post-exploration land uses of cattle grazing, wildlife habitat, and <br />recreation.
