Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety received a Notice of Intent to Explore from Western <br />Fuels Association Inc for the Third Park Project on February l4, 2007. The Division has assigned the <br />number X-2007-142-10 to this Notice of Intent. The Division has reviewed this Notice of Intent, and, <br />in accordance with the Colorado Surface Coal Mining Act and the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining, hereby notifies you of the following: <br />Determination of Proposed Activities as Coal Exploration [Regulations 2.02.2(1) and 1.04(22)] <br />The activities described in the Notice of Intent qualify as "coal exploration" as defined at Regulation <br />1.04(22). The coal exploration activities described will involve removal of 250 tons or less of coal. <br />Determination of Completeness [Regulation 2.02.2(2)] <br />The Notice of Intent is hereby deemed "Incomplete" as of today, for the following reasons: <br />In accordance with the requirements of Regulation 2.02.2(2)(e), please provide a copy <br />of the US BLM's approval of Westem Fuels' application for an Exploration License for <br />the federal lands and minerals associated with this project. Please indicate the date of <br />BLM's approval, any specific designation (name, number, etc) given by the BLM for <br />the Exploration License, and the date (if any) that the Exploration License will expire. <br />2. It appears from "Map 1" of this project that surface access to 82 drill holes (NHTP06- <br />O1 through NHTP06-81, including NHTP06-38b) of the 98 drill holes proposed by this <br />Office of Office of <br />Mined Land Reclamation Denver .Grand Junction Durango Active and Inactive Mines <br />
