Walther <br /> / Execulrve Director <br />RE: Technical Adequacy Review for New 110 Permit Application, Permit No. #M-2000-037, Baxter Pass Gravel ~dlv on Director <br />Dear Mr. Rasmussen, <br />This letter is being written to address issues which need clazification in the technical revision submitted by your <br />company to [he Division of Minerals and Geology (DMG) on March 13, Permit No. #M-2000-037, Baxter Pass <br />Gravel Pit. Please address the following concern prior to the decision due date of April 12, 2000. <br />1. How many acres will be disturbed at one time? Please specify the maximum disturbance of acreage. <br />2. The specified .seed mix does not contain enough species variation to fulfill the requirements of Rule 3.1.10(1) <br />of the Construction Materials Rules and Regulations, which states that "land shall be re-vegetated in such a way <br />as [o establish a diverse, effective, and long-lasting vegetative cover." The amount of seed specified is <br />approximately half of the standard seeding rate, as well, and should be increased to the norm. Will fertilizer and <br />mulch be used on the site? If so, please specify the fertilizing and mulching rates. If not, please explain why <br />these measures should not be required at this site. <br />3. The email from David Malrisciano, giving permission for Rio Blanco County to be within 200' of the buried <br />KN Energy pipeline, must be replaced by a signed letter on the company letterhead in order to be a valid waiver <br />of the setback requirements. Please submit this to the Division, in accordance with Rule 6.3.12 of the <br />Conswction Materials Rules and Regulations. <br />Please be advised that this application may be deemed inadequate, and your application could be denied on April 12, <br />unless the adequacy items listed above are addressed to the satisfaction of the Division. If you wish, you may request <br />an extension to the decision due date, to allow for more time to resolve these issues.
