JERIS A, DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: RA7\QSOUR BROS. -EMPIRE PIT, CLEAR CREEK COUNTY, APPLICA- <br />TION FOR MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application for a gravel <br />pit near Empire. We will not recommend approval of the application until <br />the applicant has provided the following additional information: <br />1. Exhibit G includes a letter stating that 4.5 acre-feet of <br />water annually is available to the applicant. We need <br />the name of the water right, the appropriation and adjudi- <br />cation date, and the decreed use of the water. In order <br />to be used for gravel washing and dust control, the right <br />must be decreed for mining or industrial purposes. <br />2. Exhibit G states the 6 to 8 acre-feet of water will be <br />required annually for irrigation. The source of this water <br />is not identified. <br />3, Exhibit G states that the waste water "lagoons have no <br />discharge system". In order to prevent injury to the <br />critically over-appropriated Clear Creek and South Platte <br />River Basins, the applicant must evaluate the effects of <br />these lagoons on water rights along Clear Creek. <br />4. Exhibit D states that dewatering will be required during <br />mining. The applicant has failed to evaluate the effects <br />of dewatering on any wells located near the pit. <br /> <br />
