SUBJECT: RA7\QSOUR BROS. -EMPIRE PIT, CLEAR CREEK COUNTY, APPLICA-
TION FOR MINING AND RECLAMATION PERMIT
As requested by your office, we have reviewed the application for a gravel
pit near Empire. We will not recommend approval of the application until
the applicant has provided the following additional information:
1. Exhibit G includes a letter stating that 4.5 acre-feet of
water annually is available to the applicant. We need
the name of the water right, the appropriation and adjudi-
cation date, and the decreed use of the water. In order
to be used for gravel washing and dust control, the right
must be decreed for mining or industrial purposes.
2. Exhibit G states the 6 to 8 acre-feet of water will be
required annually for irrigation. The source of this water
is not identified.
3, Exhibit G states that the waste water "lagoons have no
discharge system". In order to prevent injury to the
critically over-appropriated Clear Creek and South Platte
River Basins, the applicant must evaluate the effects of
these lagoons on water rights along Clear Creek.
4. Exhibit D states that dewatering will be required during
mining. The applicant has failed to evaluate the effects
of dewatering on any wells located near the pit.
