As we understand it, <br />the purpose of the hearing is the current requirement that State <br />agencies consult with the Colorado Historical Society regarding <br />the need to conduct cultural resources surveys on State permits <br />and other actions involving State agency actions, approval, or <br />assistance. Article 80.1 of Colorado Revised Statute 24 <br />regarding the protection of sites and structures of historical <br />significance in the State of Colorado, as currently implemented, <br />requires State agencies to seek the Society's views in this <br />regard. <br />At question is the issue of whether or rlot the Act, and its <br />implementing procedures, specifically requires State agencies, <br />prior to taking an action, to complete cultural resource surveys <br />for the purpose of locating previously unidentified properties of <br />historical significance. This letter is to encourage you to <br />render a decision that ensures State agencies continue to <br />identify and consider the effects of State actions, including <br />permit issuance, on historic properties in a manner consistent <br />with the requirements of Federal law. <br />
