The Lessor may amend these stipulations a[ any [fine without [he <br /> consent of [he Lessee in order to make these Stipulations consistent with any new Federal <br /> or State statutes and with regulations issued under chase statutes. The lessor and the <br /> Lessee agree mutually [o decide upon the feasibiLi[y and need for amending [he existing <br /> S[Lpula[ions. They will ac[ in good faith and exercise a sincere effort to make the <br /> Lessee's activities under the Lease as free from environmental damage as is practicable. <br /> (a) This lease shall be terminated when all the strippable reserves in [he Wadge and any <br /> overlying coal beds have been produced from the lands described in Sec. 2 and the surface <br /> has been reclaimed to the satisfaction of [he District Manager. <br /> (b) The lessee shall utilize and operate all facilities and devices in accordance with <br /> all applicable air quality standards and related plans of implementation adopted pursuant <br /> [o [he Clean Air Act (77 Stat. 392, as amended, 42 U.S.C. 1857) as now in effect or as <br /> hereafter amended, or if i[ should be superseded, [he statute superseding it, and ap- <br /> plicable Stale standards. <br /> (c) The Lessee shall utilize and operate all facilities and devices in accordance with <br /> State and Federal statutes (including, but not limited to, the Federal Water Pollution <br /> Control Act (62 Stat. 1155, as amended, 33 U.S.C. 1251-1376))and regulations as now in <br /> effect or as hereafter amended, or if they should be superseded, the statute and regu- <br /> lations superseding them. <br /> (d) The leased lands shall be rehabilitated in a manner [hat will avoid or minimize <br /> environmental impacts off [he leased lands and be in accordance with Federal, state, and <br /> local surface rehabilitation statutes and regulations. <br /> (e) The Interior Department expressly reserves the right [o increase the amount of the <br /> bond in the amount sufficient to cover [he cost of reclamation at the time of approval of <br /> the mining plan. <br />• (f) Riparian vegetation along Foidel Creek and its perennial tributary shall be protected <br /> by leaving a two hundred (200) foot buffer zone along each side of the creek. This buffer <br /> zone shall remain undisturbed in [he exploration and mining process. <br /> (g) No channel encroachment or relocation will be permitted on either the Foidel Creek <br /> drainage or Flsh Creek. <br /> (h) RATE OF PRODUCTION: <br /> Effective date of lease thru 12-31-79 - Maximum of 4,013,000 Tons, less 334,417 Tons <br /> for each month of 1979 not included in the <br /> lease term. <br />1980 - - - - - - - - - - - - - - - - - - - - Maximum of 3,848,000 Tons. <br />1981 d all subsequent years - - - - - - - - - Maximum of 3,796,512 Tons per year. <br /> <br />
