't'his matter came on for a hearing on May 24, 2005. Appearing for
Plaintiff were Coleman and Roushar, appearing for Defendant Montrose County
was Hill, appearing for Defendant Lary A was Thomas. The Court heard
testimony from Ron Barrett, a licensed surveyor engaged by Plaintiff, from Pat
Coleman, the former Montrose County Attorney, and from Brian Wilson, the
Montrose County engineer. At counsel's request a briefing schedule was
established, rather than oral closing arguments. All brleflng has now been
concluded. The Court hereby finds, concludes, and orders as follows:
