RE: Public Notice-Bonser Pit, File No. M-2000-156
Dear Mr. Coulson
During the Division's review of your Public Notice for the Bonser Pit it was discovered that the noticed
proposed future use of the land is agricultural. Since your re-submittal of the Reclamation Plan, received on
August 22, 2001, now proposes to reclaim the pit as a water storage reservoir, the public notice is no longer
correct. We wish to bring your attention to Rule 1.6.6, which reads as follows:
1.6.6 Conditions that Require New Notice to the Public
/f a notice is in error or a change to the application is so substarLtial, as determined by the office, that it
effects any of the terms contained in the notice that was published in the newspaper or mailed to the owners of
the affected and adjacent lands, or the change is an amendment to the application, the applicant shall be
required to publish and mail a new notice of the application. In the event that the applicant is required to issue
a new notice, nll applicable deadlines shall begin to run anew.
Please notify the Division as to when the new public comment period will end so we can set the new decision
due date.
