Cottony <br />Acting Division Director <br />I am in reciept of your letter requesting an extension of the decision date for the subject permit application <br />from November 25, 2002 to November 29, 2002 to accommodate for a delay in publishing the notice. This is <br />not a problem, according to paragraph 1.4.1(13) of the rules below, the Office can add the number of days to <br />the decision date that the publication was delayed compared to the required 10 days. <br />"1.4.1 (13) Failure of an Applicant to publish the notice pursuant to Paragraph 1.6.2(1){d) shall add a <br />sufficient number of days for the required public notice to be accomplished. An additional time period, as <br />determined by the Office, may be added for the Office or Board to make a decision. Such time period shall <br />not exceed thirty (30) days for any 110 or 110(6) Limited Impact application, ninety (90) days for any 112 <br />Reclamation Permit application without objections, or 120 days for any 112 Reclamation Permit application <br />with objections." <br />Your request is in compliance the above, and is hereby accepted. The new decision date is November 29, <br />2002 <br />I plan to send my adequacy comments in the next few days, and conduct apre-operation inspection. I will <br />contact you to arrange a time.
