._ <br />~~...~- <br />A <br />.. r <br />mine block will proceed underground in a southerly direction <br />from the portal o! Applicant's Mt. Gunnison No. 1 Mine, which <br />portal is located on the south side of the North Fork <br />Gunnison River as tollows: <br />804.81 feet South of the North line and 1406.25 <br />feet West of the Eaet line of Section 16, <br />Township 13 South, Range 90 West of the 6th Prime <br />Meridian. <br />6. Mining will, as pertinent to this plan for <br />augmentation, extract coal beneath the natural basins <br />of the following natural and Intermittent streams: <br />a. the Dry Fork of Minnesota Creek, and its <br />tributaries; and <br />b. Lick Creek, __ <br /> <br /> <br />both of which are tributaries of Minnesota Creek, a tributary <br />of the North'Fork Gunnison River. <br />7. Applicant will conduct primary or developmental <br />mining of the mine block, and secondary or retreat mining <br />activities. The term "retreat mining," for purposes of this <br />judgment and decree, means secondary mining, occurring (as to <br />a. given area of the mine) after primary or developmental <br />mining, during the course of which a percentage of the <br />supporting pillars left during developmental mining are <br />removed. There is a potential that land subsidence and <br />fracturing of the overburden will follow retreat.mininq <br />activity. Subsidence, should it occur, could cause reduc- <br />tions in stream flow in the above-named streams through, for <br />example, seepage of surface water into a subsidence crack. <br />8. In order to avoid such reduction, or to cure it <br />should it occur, Applicant adogted, in the course of the <br />permitting process for its mine, a Plan for Protection of <br />Minnesota Creek Water Supplies (hereinafter protection plan), <br />attached as Exhibit 1. IInder that protection plan, or any <br />amendment thereto, should a loss of surface water occur as a <br />result of retreat mining, Applicant may cure-that loss in <br />one or more of the following ways: <br />(a) if the source of surface water loss is readily <br />observable, Applicant will culvert the surface flow across <br />the point of leakage, a technique that may also be used as a <br />follow-up to the measure identified in (b) below; <br />(b) if the source of water loss is not readily identi- <br />fiable but a water loss 1s indicated by monitoring, and <br />water is accruing to the mine drifts, Applicant-will drill <br />-2- <br />
