O. Box 731
Carton Ciry, Colorado 81215-0731
Reference: Limited Impact Mining Operation
Dear Mr. Vestal;
The Fremont County Department of Planning and Zoning has been put on notice of your company's intent to apply for a
reclamation permit with the Colorado Division of Minerals and Geology to mine for gypsum, in Fremont County. The
property in question is located in the Agricultural Forestry Zone District. 'This District allows mining only after the
issuance of a Conditional Use Permit. In order to be granted a Conditional Use Permit, an application must be made with
the Departmen[, review of the application by the Fremont County Planning Commission at a public meeting and approval
of the application by the Fremont County Board of County Commissioners at a public hearing. This process takes between
sixty (60) and ninety (90) days, if there are no complications. Mining without the issuance of a Conditional Use Permit
would be a violation of the Fremont County Zoning Resolution.
I would suggest that your company contact the Department and obtain handout information concerning Conditional Use
Permits. Once your representative has had an opportunity to read the information, it may be in your company's best
interest to contact the Department and schedule an appointment with either Bill Giordano, Director or myself to discuss the
application and process. ,'
If you have questions, feel free to contact the Departrnent.
Sincerely, f
~~~~<~
M shall Butler
Assistant Planning Director
c: James Stevens, Senior Reclamation Specialist
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
Roben Clift, Disttict Manager
Colorado State Land Board
201 West 8'" Street, Suite 307
Pueblo, Colorado 81003
