Townsend State Historic Preservation Officer Colorado Heritage Center 1300 Broadway Denver, Colorado 80203 RE: Sunflower Energy Corporation's Blue Ribbon Mine Plan Dear Mr. Townsend: The Office of Surface Mining (OSM) has completed the Apparent Completeness Review of the cultural resources portions of the Blue Ribbon Subsurface Nine Plan. On the basis of a limited cultural resource survey~my staff has found no sites which are eligible for listing in the National Register of Historic Places that will be directly impacted by mining operations. The review, however, has determined that lands which have the potential for post mining subsidence have not been investigated for cultural resources. • We believe that approval of this mine plan with the following stipulations will have no effect on known cultural resources. IC is the intention of this o.`fice to conduct an inhouse sample cultural resource-oriented survey of these potentially affected lands before July 1981. If the survey locates cultural resources, additional consultation with your office will be required. Proposed Stipulations A. If cultural materials are located as a result of the survey, they will be recorded by the Office of Surface Mining and the documentation will be turned over to the applicant. Within 60 days of receiving completed survey forms, the applicant in conjunction with OSM, the Forest Service, and the State Historic Preservation Officer (SHPO) will request a determination of eligibility.. Additionally, it is the responsibility of the applicant to formulate within 90 days of receiving the OSM survey forms a mitigation plan for eligible sites threatened by potential subsidence acceptable to the above agencies and the Advisory Council for Historic Preservation. Preservation and or mitigation of impacted cultural resources is the responsibility of the applicant. B. Tf previously unidentified cultural resources should be discovered during mining operations, the operator shall insure [hat the site is not disturbed and shall immediately cease land disturbing activities within the vicinity of [he site and notify the regulatory authority. The operator shall ensure that the resource(s) is properly evaluated in terms of the National Register (36 . CFR 60.6).
