Townsend <br />State Historic Preservation Officer <br />Colorado Heritage Center <br />1300 Broadway <br />Denver, Colorado 80203 <br />RE: Sunflower Energy Corporation's Blue Ribbon Mine Plan <br />Dear Mr. Townsend: <br />The Office of Surface Mining (OSM) has completed the Apparent Completeness <br />Review of the cultural resources portions of the Blue Ribbon Subsurface Nine <br />Plan. On the basis of a limited cultural resource survey~my staff has found <br />no sites which are eligible for listing in the National Register of Historic <br />Places that will be directly impacted by mining operations. The review, <br />however, has determined that lands which have the potential for post mining <br />subsidence have not been investigated for cultural resources. <br />• We believe that approval of this mine plan with the following stipulations <br />will have no effect on known cultural resources. IC is the intention of this <br />o.`fice to conduct an inhouse sample cultural resource-oriented survey of these <br />potentially affected lands before July 1981. If the survey locates cultural <br />resources, additional consultation with your office will be required. <br />Proposed Stipulations <br />A. If cultural materials are located as a result of the survey, they will be <br />recorded by the Office of Surface Mining and the documentation will be turned <br />over to the applicant. Within 60 days of receiving completed survey forms, <br />the applicant in conjunction with OSM, the Forest Service, and the State <br />Historic Preservation Officer (SHPO) will request a determination of <br />eligibility.. Additionally, it is the responsibility of the applicant to <br />formulate within 90 days of receiving the OSM survey forms a mitigation plan <br />for eligible sites threatened by potential subsidence acceptable to the above <br />agencies and the Advisory Council for Historic Preservation. Preservation and <br />or mitigation of impacted cultural resources is the responsibility of the <br />applicant. <br />B. Tf previously unidentified cultural resources should be discovered during <br />mining operations, the operator shall insure [hat the site is not disturbed <br />and shall immediately cease land disturbing activities within the vicinity of <br />[he site and notify the regulatory authority. The operator shall ensure that <br />the resource(s) is properly evaluated in terms of the National Register (36 <br />. CFR 60.6).
