Box 580 Drvrsion Director <br />Rye, CO. 81069 <br />RE: Adequacy Review Permit Number M- 98-038 <br />Deaz Mr. Kirkland: <br />The Division has reviewed your 112 Construction Materials Permit Application and has the <br />following concerns. <br />I) General: <br />It is the understanding of the Division from the information provided that the existing 111 permit <br />(M-98-010) is not included in this application. <br />11) Exhibit "C" <br />Under Rule 6.4.3 "C", the operator is required to identify all man made structures. Are the ones <br />indicated in the application the only man made structures in the area to be affected and within <br />200 feet of all boundazies of the azea to be affected? <br />III) Exhibit "D' and "G" (MINING PLAN AND WATER INFORMATION) 6.4.4 AND 6.4.7 <br />Under your sub- heading "g", the operator stated ,"the hot plant and concrete plant will be <br />contained by a berm in compassing the plant site. We will also put HDPE lined sediment ponds <br />at the low spot inside the bermed area. <br />1) Are these plants portable or permanent ?If they are going to be housed in permanent <br />structures, please provide a detailed design for the structures that will house these units and the <br />material that will be utilized to construct these structures. <br />2)Please provide the design for the berms and HDPE lined ponds and show their locations in the <br />appropriate maps and Exhibits. <br />Under sub- heading "J" the operator states , "The State Engineer has requested we stay 18" above <br />
