After re-inspecting the site on April 8, <br />we have found that Asphalt Paving had not mined into the setback. <br />However, a technical revision to your permit is required to <br />continue the current mining practice of excavating the pit at <br />slopes steeper than 3H:1V. We believe that handling this as a <br />problem instead of a possible violation is more appropriate at this <br />time. <br />The scheduled Formal Public Hearing for consideration of the <br />possible violation has been withdrawn, and you do not need to <br />appear at the April 24-25 Board Hearing. <br />If you have any questions, please contact me at (303) 866-3567. <br />Sincerely, <br /> <br />Christina L.
