Townsend <br />Stale Historic Preservation Officer <br />Colorado 11eri[age Center <br />1300 Broadway <br />Denver, Colorado 80203 <br />RE: Kerr Coal Company's Marr Strip Mine Plan (CO 0002) <br />Dear Mr. Townsend: <br />The Office of Surface Mining has completed the Apparent Completeness Review of <br />the cultural resources portions of the Marr Strip Mine Plan. My staff has <br />found that there is only one site which is eligible for listing in the <br />National Register of Historic Places {SJA416) within the mine plan area. <br />Apparently your staff and the Advisory Council on Historic Preservation has <br />concurred with the BLM determination of "No Effect". (see attachments I)1 and <br />Ill) Therefore, with [he following stipulations I believe that the approval of <br />thie mine plan will have no effect on sites which are eligible for listing in <br />the National Register of Historic Places: <br />1) During mining operations if any previously unidentified cultural <br />resources should be discovered, the operator shall immediately cease land <br />disturbing activities within the vicinity of the site and shall notify the <br />regulatory authority. Activities shall not resume until the operator has _ <br />had the resource(s) properly evaluated in terms of the National Register <br />of Historic Places eligibility criteria (36 CFR 60.6) and the regulatory <br />authority and the Colorado State Historic Preservation Officer have been <br />consulted. Should a resource be determined eligible for listing in the <br />National Register of Historic Places [he operator shall consult with and <br />obtain [he approval of the regulatory authority concerning the development <br />and implementation of mitigation measures as appropriate. <br />2) Within 30 days of acceptance of Departmental approval the company will <br />construct a fence around archaeological site 5JA416, and will ensure that <br />no surface disturbing activities occur within the fenced area nor within <br />50 feet of [his fenced area.
