<br />,, <br />MEMORANDUM <br />'` Job File 477EFC01 <br />June 30, 1960 <br />I spoke with Jerry Zimpfer at the State's Mined Land <br />Reclamation Board regarding his interpretation of this <br />section. He stated that the situation had never come up <br />before to his knowledge, but that he at this time was open <br />to the more favorable (lesser) interpretation. While he <br />would not commit the Mined Land Reclamation Board formally, <br />he was agreeable to us writing a letter stating our case <br />and requesting interpretation. He also asked that I call <br />John Nadolski at the OSM for that agency's response. <br />I called John on June 25, but did not get a return call <br />until June 30. He stated that the OSM had no problem with <br />the more favorable interpretation since it considers the <br />crest of the primary spillways to be the point at which <br />head is measured. This would correspond to our sedimenta- <br />tion elevation. According to John, while this hasn't come up <br />• before in Colorado, the matter has been addressed in other <br />states, particularly back east. <br />I called Jeff Saunders this morning and spoke with <br />Gary Myers because Jeff was out.
