,,
MEMORANDUM
'` Job File 477EFC01
June 30, 1960
I spoke with Jerry Zimpfer at the State's Mined Land
Reclamation Board regarding his interpretation of this
section. He stated that the situation had never come up
before to his knowledge, but that he at this time was open
to the more favorable (lesser) interpretation. While he
would not commit the Mined Land Reclamation Board formally,
he was agreeable to us writing a letter stating our case
and requesting interpretation. He also asked that I call
John Nadolski at the OSM for that agency's response.
I called John on June 25, but did not get a return call
until June 30. He stated that the OSM had no problem with
the more favorable interpretation since it considers the
crest of the primary spillways to be the point at which
head is measured. This would correspond to our sedimenta-
tion elevation. According to John, while this hasn't come up
• before in Colorado, the matter has been addressed in other
states, particularly back east.
I called Jeff Saunders this morning and spoke with
Gary Myers because Jeff was out. Gary though that I should
revise the pond schedule on the current mine drawings to
reflect this latest interpretation.
~•
4
~'
t)
L
f'
Leonard Rice Consulting Water Engineers, h~
