That Getty shall agree to move the cattle guard <br />at Getty's expense when/if the County realigns the <br />intersection. <br />WHEREAS, Getty now has submitted to Routt County a <br />General Warranty Deed acceptable to the County Attorney <br />which deed conveys to Routt County not only a surface estate <br />in the lands contemplated by condition ~1 listed above, but <br />also such lands as would allow for the realignment of the <br />intersection above referenced to allow for a 250 foot radius <br />curve; and <br />WHEREAS, the Board of County Commissioners has <br />determined that the lands granted for the intersection. <br />realignment are sufficient to satisfy the County's concern; <br />WHEREAS, the lands granted will not require reloca- <br />tion of the cattle guard; <br />NOW, THEREFORE, BE IT RESOLVED that that portion of <br />County Road 179 Located north of the junction of County Road <br />179 with County Road 33 in Section 33, TSN, R86W of the 6th <br />P.M. and south of the junction of County Road 179 with the <br />Twentymile Coal Company haulroad located in Section 1, TSN, <br />R86W of the 6th P.K. be and hereby is vacated and per- <br />manently relocated as set forth herein. <br />/ ~ day of ,~ Gr~~:rv 1985. <br />UPON MOTION duly made, seconded, and passed this <br />ATTEST: <br />Kim Bonner, County Clerk <br />VOTE: <br />WILLIA~y HAIGHT <br />ROBERT E.
