However, the issues identified within your <br />9/3/98 letter do not appear to indicate conflict with the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, 34-32.5-101 at seo•, C.R.S. (Act/, or the Construction Material <br />Rules and Regulations of the Colorado Mined Land Reclamation Board (Rules), and/or do not appear <br />to be jurisdictional issues for DMG. <br />Please keep in mind that DMG only has authority to enforce the above referenced Act and Rules. <br />Additionally, DMG does not enforce permit conditions for permits issued by other agencies. Traffic <br />issues are generally addressed at the local government level. Air pollution issues are addressed by <br />the Colorado Department of Public Health and Environment, Air Pollution Control Division, Stationary <br />Sources Section, 4300 Cherry Creek South Drive, Denver, CO 80220. <br />Should you disagree with DMG on these issues, you have the right to a hearing before the Colorado <br />Mined Land Reclamation Board for consideration. DMG will schedule a hearing for you upon receipt <br />of a request for a Formal Public Hearing. <br />Thank you for informing DMG of activities conducted at the Stone Gravel Pit.
