Co-0027529 and CO-0036056 i
San Juan County
Dear Mr. Perino:
After conversations with you and with Jim Stevens of the Colorado Divi.eion of
Minerals and Geology (CDMG), and after reviewing the Division files, we have
determined that a decision on whether to authorize moving the discharge point for
the American Tunnel permit (CO-0027529) must be delayed until the CDMG zrpprovea
the hydraulic plugs. They have informed us that ae part of their review F~rocese,
they will review geological and hydrological information submitted by you with
your design report in order to ensure that all sources of water from your
property will be permanently eliminated when the plugs are installed. Tttey have
indicated that they will not approve the project unless they are convinced that
no water will be able to discharge down the tunnel from your property alter the
plugs are in place. It appears after talking with CDMG that if the F~lugging
project ie approved by them, it may also fully address our concerns; and
therefore, relocation of the discharge point would likely be appropriate.
L-T t. wl~c.t-?
Ae I am sure you are aware, some similar projects at other sites have oat shown
~. to be successful on a long term basis; therefore, until such time ae this project
is approved and we are satisfied with the review process, a decision from us
regarding relocation of the discharge point would be premature. Additionally,
you are probably aware that a reasonable period would be required after ttte plugs
have been installed to demonstrate the long term success of this particular
project prior to consideration of inactivation of your CDPS permit.
We will keep your amendment request on file and make a decision regardingf moving
the discharge point for permit CA-0027529 when CDMG approves the plugging.
You expressed concerns about possibly violating the date for compliance w).th your
whole effluent toxicity (WET) acute limitation due to a delay in completion of
the plugging past June, 1993. You have stated that it is your goal to acheive
compliance through cessation of all discharge. This course of action appears
acceptable.
