We have received a <br />6naneiai warranty in the amount of $145,500 for Phase I of the operation, but we have not received a completed <br />perfom7ance warranty from Coulson Excavating. I have attached a perfom7ance warranty form for your use. We <br />also have not received proof of co7lg7kting re-notiSption and re-publication rcquirembnts ss specified in the <br />Division's September 28, 2004 comspondence. . <br />Please submit a completed performance warranty formand proof of re-notification and te-publicafioo at your <br />earliest possible convenience. All such items will need to be received in our office prior to the scheduled re- <br />consideration hearing before the Board. In addition tocompleting re-notification and re-publicationprocedlaes as <br />specified in Rule 1.6, please be aware tbat if any surface owners, easement owners, and owners of permanent man- <br />made structures within 200 feet of the affected land are different than what was submitted in the approved <br />application, then new maps and e7du"bits wilt need to be submitted to the Division Also, if any new permanent man- <br />made stmctures have been constmcted within 200 feet of the affected land since the initial review period, then the <br />applicant will need to der77onstrate compliance with Rule G4.19 regarding permanent man-made struchuea Please <br />verify whether any such changes have accmred since August 12, 2003. <br />Please call me at (303) 866-35117 if you have any questions. <br />Sincerely, <br />.A ,~~y~'iG4~WG~ <br />Thomas A.
