SPECIAL STIPULATIONS <br />• Coel Lease D-046544 <br />(a) Cultural Resources. (1) Before undertaking any surface disturbing <br />activities on leased lands, [he lessee shall conduct en intensive (Class III) <br />survey for cultural resources covering appropriate portions of the mine plan <br />and/or the exploration area. This inventory shall be conducted by a qualified <br />professional cultural resource specialist ae defined in the Secretary of the <br />Interior's "Archaeology and Historic Preservation: Standards and Guidelines." <br />(2) A report of the above inventory, including recommendations for <br />protecting those significant cultural resources identified, shall be submitted <br />to the Assistant Director, Western Field Operations, Office of Surface Mining <br />Reclamation and Enforcement (OSMRE) and to the authorized officer of the <br />appropriate surface management agency. The lessee shall not commence surface <br />disturbing activities until permission to proceed is provided by the OSMRE <br />Assistant Director or by the appropriate surface management agency's <br />authorized officer. <br />(3) The lessee shall protect all significant cultural resources within the <br />lease area until appropriate measures to mitigate can be implemented as part <br />of an approved mining and reclamation plan or an exploration plan. <br />(4) The coat of conducting the inventory, preparing reports, and carrying <br />out adequate mitigation measures shall be borne entirely by the lessee. <br />• (5) If cultural resources are discovered during operations, the lessee <br />shall immediately notify the OST[RE Assistant Director or the Bureau of Land <br />Management's authorized officer. The lessee shall not disturb such <br />discoveries. Within five (5) working days, the Assistant Director (or <br />authorized officer of the appropriate surface management agency) will <br />evaluate, or cause to have evaluated, any cultural resources discovered and <br />will determine if any action may be required to protect or preserve these <br />discoveries. Cost of recovery/mitigation of these resources shall be borne by <br />the lessee. <br />(6) All cultural resurces discovered shall remain under the jurisdiction <br />of the United States of America until ownership is determined under applicable <br />law. <br />(b) Paleontologic Resources. (1) Prior to any surface or subsurface <br />disturbing activities, the operator shall contact the authorized officer to <br />determine whether a paleontological survey of the proposed area of disturbance <br />will be required by an approved paleontologist. <br />(2) The operator shall not knowingly disturb, alter, destroy, or take any <br />fossils of scientific value that may be discovered. <br />(3) The operator shall immediately cease all operations upon discovery of <br />. fossils of scientific value and will immediately notify the authorized <br />officer.
